Sorry, what I meant to say is they probably didn't submit their work to a governing body to be able to sue for damages. That's not to say that they can't do that, however the damages that a plaintiff can is lessened by a wide margin if they haven't sent a copy of their work to a government body...

I doubt they actually did the paperwork to copyright their work. @LaFuta but it would be in bad practice to continue someone else's work without the original authors consent. Because if it does gain a bigger audience than the original author, then they might try to want royalties or something...
